Andrew Brumby counsels businesses on ways to repair financial relationships with companies in distress, including recovering debt or restructuring deals to protect his clients' interests and maintain profitability. A partner in the Orlando office, Mr. Brumby uses more than 30 years of experience to lead the firm's Creditors' Rights Practice Group.
Experience
While practicing commercial finance, bankruptcy, insolvency and creditors' rights litigation, Mr. Brumby has handled a wide range of cases in different industries. He often counsels secured and unsecured creditors, creditors committees, receivers and trustees in state and federal insolvency proceedings. He has served as a court appointed examiner in Chapter 11 cases.
Mr. Brumby represents companies throughout Florida's large real estate market as well. He has represented commercial lenders, for example, in workouts and restructuring transactions, including commercial foreclosure issues and related limited liability suits.
In past years, Mr. Brumby has also handled large First Amendment cases for local governments trying to regulate adult entertainment establishments.
Professional Activities
The first president of the Central Florida Bankruptcy Law Association, Mr. Brumby served on its Board of Directors from its inception through 1996. He is also a former Chairman of the Ninth Judicial Circuit Grievance Committee of The Florida Bar. Current memberships include The Florida Bar's Bankruptcy/UCC Committee and the American Bankruptcy Institute. He is a frequent speaker on creditors' rights and insolvency issues.
Representative Cases
Mr. Brumby represented a borrower in the bankruptcy case of a financial services company, following a multi-million dollar cessation of construction funding, in mid-project.
He has worked with several commercial mortgage-backed securities lenders (CMBS) and servicers in troubled loan workouts, including bankruptcy.
Mr. Brumby represented the purchaser of equipment that was specially designed, but defectively manufactured, by enjoining the draw on an international stand-by letter of credit, set up by a now bankrupt Italian company.
