William Bernard (“Bernie”) McCarthy is a partner in the Trusts and Estates Practice Group of the firm's Miami office. His practice focuses on tax controversy issues, including IRS procedures, dispute resolution techniques, as well as tax related litigation.
Prior to joining Shutts & Bowen, Mr. McCarthy was a director with KPMG LLP, where his practice focused on resolving tax controversies on a wide range of technical and procedural issues before all divisions of the IRS. Before joining KPMG, he was an agent and appeals officer with the Internal Revenue Service (1982–1987) and a trial attorney with the Chief Counsel’s Office of the IRS (1987–2000). Concurrent with his tenure in the Chief Counsel's Office, Mr. McCarthy also held an appointment as a Special Assistant U.S. Attorney (1992-1997). He has litigated a number of reported tax cases, including: Hospital Corporation of America v. Commissioner (depreciation/cost segregation studies); Hill v. Commissioner (fraud); and Feldman v. Commissioner (movie tax shelter).
Mr. McCarthy has been an instructor at IRS Continuing Education Programs and has spoken before numerous professional organizations, including The Florida Bar Tax Section and the Tax Executives Institute. He currently co-chairs the IRS Collections Committee of the Bar’s Tax Section. He also regularly provides pro bono services on behalf of the Legal Aid Society of the Dade County Bar. Mr. McCarthy has been licensed as a Certified Public Accountant in Texas and Florida and, prior to his career with the IRS, he was a firefighter and paramedic.
