Our construction law experience emphasizes arbitration, litigation and mediation of construction disputes. However, our experience also includes preparing contracts, agreements and subcontracts for established and emerging project forms (traditional, CM, fast-track, multi-prime, phased) and drafting architectural and engineering consultant agreements.
In the litigation arena, we have handled matters involving construction or product warranty enforcement and defense; insurance considerations; design errors; and mechanic’s liens, including pre-construction advice on how to preserve lien rights or the avoidance of lien attachment.
Additionally, we have experience dealing with complex delay and additional compensation claim analysis and resolution; payment and performance bond enforcement and defense on private and public jobs (federal or state).
We have also been involved in the resolution of public or private bidding problems, including bid protests; and in contracting with federal, state and local governments.
Representative Construction Litigation
- Represented contractor in suit for damages for acceleration and disruption at an internationally renowned entertainment complex.
- Represented mechanical subcontractor in successful settlement of multi-million dollar claim for construction of a launch complex at Cape Canaveral.
- Represented owner in claims against contractor and defense of claims by contractor, for costs overruns on construction of largest restaurant in major Las Vegas hotel.
- Represented contractor in multi-million dispute with owner relating to claims for water intrusion in oceanfront hotel, and claims against architects for defective drawings and specifications.
- Defended owner of numerous furniture franchises in claim alleging differing site conditions, delays, disputed change orders, defective HVAC system, and fraudulent lien.
- Represented general contractor on $4.5 million claim on $24 million project for construction of exhibit at internationally renowned theme park. Claim involved delay/disruption, extra work, faulty plans and specifications, acceleration and other complex construction issues.
