Members of Shutts & Bowen’s Class Action Practice Group litigate a wide variety of class action matters in diverse industries including banking, insurance, consumer finance, consumer products, construction, telecommunications, and pharmaceuticals.  We have handled numerous federal and state substantive class action claims ranging from product liability, breach of contract, and consumer fraud claims to securities, torts, and deceptive trade practices claims.

Members of our Class Action Practice Group are frequent speakers on class action litigation and are active in local and national Rules Committees involving complex litigation issues.

We are frequently consulted by clients to implement measures to protect against exposure to class litigation, and we are regularly called up on to review new company practices and procedures, to ensure that adequate protections are in place to minimize exposure to class litigation. We are also regularly consulted by clients to identify areas of their business that are vulnerable to class litigation, and to assist in remedying any areas of concern. 

In litigation, members of our Class Action Practice Group have achieved early (i.e. pre-certification) dismissal of many class action lawsuits, and have prevailed on the issue of class certification in numerous other class action cases.  Our class-wide settlements have been used as models for industry-wide settlements on several occasions, and we routinely achieve maximum res judicata protection with minimal payments by our class action clients.  We are well-versed on class action discovery issues and on class-wide trial techniques, and we regularly serve as coordinating counsel on both single-state and national levels regarding class action and other mass action litigation.
