
Shutts & Bowen LLP Orlando partner Thomas S. Cargill recently achieved a significant victory on behalf of his client, Ocala-based Associates for Cardiovascular Excellence, LLC, after a Marion County court awarded a $7,965,000 verdict to the business.
Associates for Cardiovascular Excellence (ACE), jointly represented by Thomas Cargill of Shutts & Bowen and Morgan & Morgan Business Trial Group attorneys Benjamin Webster and Katherine Thanos, was in a dispute with Dr. Asad U. Qamar, M.D., over allegations that Dr. Qamar froze out the business’ board of directors and improperly diverted company funds.
For over three and a half years, Thomas represented his client from the initial stages of the case, through all facets of litigation, concluding with a jury trial and the Court’s final verdict in favor of ACE. The trial court’s verdict enables ACE and its Board of Directors to regain control and ownership of the business and receive a substantial damages judgment.
“After more than three years of hard-fought litigation, we are pleased that the seriousness of the conduct that took place against our client was recognized and that the returned verdict restores control of the company to its rightful owners and compensates ACE for the substantial harm it suffered,” said Thomas.
