The Daily Business Review quoted Miami Office Managing Partner and Insurance Practice Group Leader John Meagher in an article titled, “Controversial Tort Measure Moves to Florida House Judiciary Committee.” The article discusses how the Florida House of Representatives Judiciary Committee will take up the civil remedies bill that places new limits on lawsuits that could make it more difficult for plaintiff attorneys to sue insurance companies by eliminating “one-way attorney fees and fee multipliers for all lines of insurance.”
Discussing the bill, John said the “one-way” fee repeal is the biggest change made by the proposed bill. This follows the Florida Legislature’s earlier repeal of “one-way” fees in property insurance litigation. The restrictions on fee multipliers, which allowed for plaintiff’s attorneys to get up to 2.5 times their actual fees, is another blow to the plaintiff’s bar.
