Ricky Polston Speaks During Joint Committee Meeting at the 2026 RPPTL Convention

Ricky Polston, a partner in the Tallahassee office of Shutts & Bowen LLP and Chair of the firm’s Constitutional Law Section, was recently a featured speaker during the joint meeting of the Commercial Real Estate, RREIL and Real Estate Finance Committees of the Real Property, Probate & Trust Law (RPPTL) Section of The Florida Bar. The meeting was held on May 28, 2026, during the 2026 RPPTL Convention at the Ponte Vedra Inn & Club.    During the presentation, Ricky discussed various methods of alternative dispute resolution, and their comparisons under the law.  He discussed property insurance use of binders and recent events concerning flood insurance. Ricky also addressed the Florida Supreme Court’s jurisdiction and its decision to not accept review of TRD Biscayne LLC, et al. v. Angelica Avila, et al. (certifying question of great public importance: “May an amendment altering the voting threshold required to terminate a condominium pass without unanimous approval where a condominium declaration both (1) requires the unanimous approval of the unit owners before either terminating the condominium or passing any amendment to the declaration of condominium altering a unit owner’s ‘voting rights’ and (2) lacks language pursuant to Kaufman v. Shere, 347 So. 2d 627 (Fla. 3d DCA 1977), automatically incorporating relevant statutory changes into such contractual provisions”).    About Ricky L. He was a Florida Supreme Court Justice from 2008-2023, serving as Chief Justice from 2012 to 2014, and was a judge at the First District Court of Appeal from 2001-2008.
