
Shutts & Bowen LLP is pleased to report that members of its Intellectual Property Group obtained a favorable ruling on behalf of their client, Deltona Transformer Corporation, in a patent infringement matter dismissed by the court.
In the case, the U.S. District Court for the Middle District of Florida granted Deltona Transformer Corporation’s Motion to Dismiss The NOCO Company’s patent infringement complaint. The Court gave NOCO fourteen days to revise its complaint in line with the Court’s instructions. NOCO did not file any amendments within that deadline.
Led by partner Patricia M. Flanagan, with assistance from partner Joseph Bain, and associates Jodi-Ann Tillman and Camila Chediak, the IP team obtained a significant result in the Court’s ruling that NOCO’s patent infringement allegations rested on outdated facts and failed to plausibly plead either direct or induced infringement. The Court further held that NOCO’s inducement theory lacked defendant‑specific allegations of knowledge and specific intent, relying instead on stale assertions predating issuance of the asserted patents.
